Asian Driving School's Terms and Conditions for Texas Instructor-Taught Driver's Ed

BACKGROUND

This Terms of Use Agreement ("CONTRACT") is a legally binding agreement between you ("STUDENT") and Asian Driving School ("COMPANY"). By enrolling in the Teen/Instructor-Led Drivers Education course, STUDENT agrees to be bound by all terms herein and applicable Texas law.

This course is approved by TDLR under Texas Education Code Chapter 1001 and provides the online classroom instruction component required for teens seeking a Texas driver license through the standard driver education pathway.

ELIGIBILITY

This course is designed for students between 14 and 17 years of age who are working toward obtaining a Texas Class C driver license through the standard driver education pathway. STUDENT must not have been convicted of any drug- or alcohol-related offense while operating a motor vehicle.

The legal guardian must review and consent to this CONTRACT before STUDENT may access the course. By proceeding, the parent or guardian acknowledges consent on behalf of the minor.

COURSE STRUCTURE AND STATE REQUIREMENTS

Pursuant to Texas Education Code Chapter 1001 and TDLR rules, teen driver education requires:

  1. 1.A minimum of 24 hours of classroom instruction (online, online-live, or in-person); and
  2. 2.A minimum of 7 hours of behind-the-wheel driving and 7 hours of observation, both conducted with a TDLR-licensed instructor.

This online course fulfills the classroom instruction requirement only. Behind-the-wheel and observation instruction must be completed separately with Asian Driving School's licensed instructors or another TDLR-licensed provider.

CERTIFICATE OF COMPLETION

This course issues two separate certificates, both available through the student portal and automatically generated upon eligibility. STUDENT is responsible for requesting each certificate — neither is issued automatically without a request.

Learner Certificate (DE-964 — Learner License): After completing the first 3 chapters with a minimum score of 70% on all assessments, STUDENT may request a Learner Certificate through the portal. This certificate is required to apply for a Texas Learner License at the Texas DPS.

Final Certificate (DE-964 — Driver License): After completing all 12 chapters and passing all modules and the final examination with a minimum score of 70%, STUDENT may request the Final Certificate of Completion. Together with proof of completed behind-the-wheel and observation hours, this certificate is required when STUDENT applies for a full Texas driver license at the Texas DPS.

The Final Certificate of Completion is required when STUDENT schedules a road test appointment — either directly with the Texas DPS or through a DPS-authorized driving school road test provider. STUDENT must present this certificate at the time of the road test appointment.

IMPACT TEXAS TEEN DRIVERS (ITTD)

Prior to the road test, STUDENT must complete the Impact Texas Teen Drivers (ITTD) program, available free of charge at impacttexasdrivers.dps.texas.gov. The printed ITTD certificate is required on the day of the road test. Asian Driving School does not administer the ITTD program; this requirement is separate from and in addition to this course.

SECURITY AND VALIDATION

This course includes TDLR-required identity and validation mechanisms. STUDENT acknowledges that only the registered STUDENT may complete this course. Allowing another person to complete coursework on STUDENT's behalf is illegal under Texas law and may result in criminal penalties, loss of the certificate, and forfeiture of all fees.

TUITION AND FEES

The total course fee is displayed at the time of enrollment and covers the online classroom instruction component. Behind-the-wheel instruction and road test fees are separate.

CANCELLATION AND REFUND POLICY

STUDENT (or parent/guardian) may request a full refund within 30 days of enrollment, subject to the conditions below.

No refund will be issued if:

  1. 1.STUDENT has successfully completed the course;
  2. 2.STUDENT has received a failing grade on Chapter 3 — at which point the enrollment becomes non-refundable;
  3. 3.STUDENT has been issued a Learner License Certificate; or
  4. 4.STUDENT has completed the first 3 chapters of the course. Once any of these conditions are met, the enrollment is considered active and non-refundable, regardless of whether the full course has been finished.

To request a refund, contact Asian Driving School at support@asiandrivingschool.us. Eligible refunds are processed within 15 business days of approval.

LEARNER LICENSE REQUIREMENTS

After completing this course and obtaining the Certificate of Completion, STUDENT must:

  1. 1.Apply for a Texas learner license at the DPS;
  2. 2.Hold the learner license for a minimum of 6 months;
  3. 3.Complete at least 30 hours of supervised driving (including 20 hours daytime and 10 hours nighttime) as logged by the parent/guardian; and
  4. 4.Complete behind-the-wheel instruction with a TDLR-licensed instructor.

All documents — including the Certificate of Completion, Verification of Enrollment (VOE) from school (if under 18), and PTDE Packet behind-the-wheel log — must be presented at the DPS when applying for a full driver license.

GOVERNING LAW

This CONTRACT is governed by Texas law. Any dispute not subject to arbitration shall be resolved in the appropriate state or federal court in Texas.
