Please read these Terms of Use carefully before accessing or using our platform. Your use of this Site or our services constitutes your acceptance of these terms. If you do not agree, do not use this Site or our services.

This Asian Driving School Terms of Use Agreement ("CONTRACT") is a legally binding agreement between you ("STUDENT") and Asian Driving School ("COMPANY"). By clicking "Accept," accessing this Site, or enrolling in any course, STUDENT agrees to be bound by all terms herein.

This CONTRACT contains a mandatory arbitration clause, a class action waiver, and a waiver of the right to a jury trial. Please review Sections 19–22 carefully.

REGULATORY AUTHORITY

Asian Driving School is licensed and regulated by the Texas Department of Licensing and Regulation (TDLR). Driver education courses are offered pursuant to Texas Education Code Chapter 1001 and Title 37, Texas Administrative Code, Chapter 84. Driving safety (defensive driving) courses are offered pursuant to Texas Occupations Code Chapter 411 and the rules adopted thereunder.

SECURITY AND VALIDATION POLICY

STUDENT acknowledges that:

1.It is illegal to attempt to circumvent any online course offered by Asian Driving School;
2.Validation and identity-verification mechanisms are in place as required by state law;
3.Any attempt to circumvent a state-approved course may result in forfeiture of the Certificate of Completion, court fines, higher insurance premiums, and/or forfeiture of all fees paid; and
4.Circumvention includes, but is not limited to, having any person other than the registered STUDENT participate in or complete the course.

STUDENT represents that all information provided to Asian Driving School is true, accurate, and complete. If Asian Driving School determines that STUDENT has misrepresented his or her identity, STUDENT will be immediately removed from the course and will forfeit all fees paid. Misrepresenting identity to obtain a state-approved certificate may constitute perjury and/or other criminal violations under Texas Penal Code, punishable by up to a 10-year prison term and a $10,000 fine, in addition to civil penalties.

Asian Driving School may access third-party databases — including driver license records and DMV data — solely to verify STUDENT identity and prevent fraud, as permitted by applicable law. Asian Driving School may also request a notarized Statement of Assurance to confirm STUDENT identity and compliance with this policy.

TUITION AND FEES

The total cost of each course is displayed at the time of enrollment. Asian Driving School accepts payment by credit card, debit card, PayPal, Apple Pay, Google Pay, and other methods as available at checkout.

Prices are subject to change without notice, but any change will not affect enrollments already completed and paid.

COURSE ACCESS AND SCHEDULE

Upon receipt of full payment, STUDENT will be granted access to the course 24 hours per day, 7 days per week ("COURSE START"). STUDENT must complete the course within 180 days of COURSE START unless otherwise stated for a specific course. STUDENT is responsible for maintaining the hardware, software, and internet connection necessary to access the course.

Scheduled or unscheduled maintenance, internet service interruptions, or other events outside Asian Driving School's control may temporarily affect course availability. If course access is unavailable due to a fault of Asian Driving School for an extended period, STUDENT must notify us at support@asiandrivingschool.us or (214) 310-5000. Asian Driving School will extend the completion deadline accordingly.

CANCELLATION AND REFUND POLICY

STUDENT may request a full refund within 30 days of purchase, provided the applicable conditions below are met. Refund eligibility varies by course type.

General Courses (Adult Drivers Ed, Defensive Driving): A full refund is available within 30 days of purchase, provided STUDENT has not successfully completed the course. A STUDENT who fails the final examination is not eligible for a refund — a failing grade on the final exam is considered course completion for refund purposes.

Parent-Taught Drivers Education (PTDE) & Self-Taught / Instructor-Led Drivers Education: No refund will be issued if:

1.STUDENT has successfully completed the course;
2.STUDENT has received a failing grade on Chapter 3 — at which point the enrollment becomes non-refundable;
3.STUDENT has been issued a Learner License Certificate; or
4.STUDENT has completed the first 3 chapters of the course. Once any of these conditions are met, the enrollment is considered active and non-refundable, regardless of whether the full course has been finished.

To request a refund, contact Asian Driving School at support@asiandrivingschool.us. Eligible refunds are processed within 15 business days. Purchases through the Apple App Store are refunded through Apple. Purchases through the Google Play Store are refunded through Google.

STUDENT REGISTRATION OBLIGATIONS

STUDENT agrees to:

1.Provide true, accurate, current, and complete registration information;
2.Promptly update registration data to keep it current;
3.Ensure that any guardian consent required for minors under 18 is obtained prior to enrollment; and
4.Comply with all applicable state laws and TDLR rules.

The legal guardian must review and consent to this CONTRACT before STUDENT may access any course. Asian Driving School reserves the right to suspend or terminate access if any registration information is found to be false, inaccurate, or incomplete.

STUDENT ACCOUNT, PASSWORD, AND SECURITY

STUDENT is responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. STUDENT must immediately notify Asian Driving School of any unauthorized use of their account or any breach of security. Asian Driving School will not be liable for any loss or damage arising from STUDENT's failure to secure their account.

STUDENT may register using an email address and password, a phone number, or through supported third-party authentication methods (e.g., Google Sign-In). Shared account access is prohibited.

NO RESALE OF SERVICE

STUDENT agrees not to sell, resell, sublicense, transfer, or exploit for any commercial purpose any portion of the course, course materials, or access credentials.

PROPRIETARY RIGHTS AND INTELLECTUAL PROPERTY

All course content — including text, graphics, video, audio, software, logos, and course materials (collectively, "Content") — is the exclusive property of Asian Driving School or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

STUDENT is granted a limited, personal, non-transferable, non-exclusive license to access and use the Content solely for the purpose of completing the enrolled course. STUDENT may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Content for any other purpose. All rights not expressly granted herein are reserved by Asian Driving School.

DISCLAIMER OF WARRANTIES

THE PLATFORM AND ALL COURSE CONTENT ARE PROVIDED "AS IS" AND "WITH ALL FAULTS." ASIAN DRIVING SCHOOL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ASIAN DRIVING SCHOOL DOES NOT WARRANT THAT: (I) ANY TRAFFIC CITATION WILL BE DISMISSED; (II) ANY INSURANCE DISCOUNT WILL BE GRANTED; OR (III) THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASIAN DRIVING SCHOOL'S TOTAL LIABILITY TO STUDENT FOR ANY CLAIM ARISING OUT OF OR RELATED TO THIS CONTRACT SHALL NOT EXCEED THE TUITION FEES PAID BY STUDENT FOR THE APPLICABLE COURSE. IN NO EVENT SHALL ASIAN DRIVING SCHOOL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

Some states do not allow limitations on implied warranties or exclusion of incidental or consequential damages, so portions of the above may not apply to STUDENT. This disclaimer gives STUDENT specific legal rights; STUDENT may also have other rights that vary by state.

INDEMNIFICATION

STUDENT agrees to indemnify, defend, and hold harmless Asian Driving School, its officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

1.STUDENT's use of or access to the platform;
2.STUDENT's violation of this CONTRACT; or
3.STUDENT's violation of any applicable law or the rights of any third party.

FORCE MAJEURE

Asian Driving School shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, government actions, internet outages, power failures, natural disasters, labor disputes, or civil unrest.

PRIVACY POLICY

Asian Driving School's Privacy Policy is incorporated herein by reference and governs the collection, use, and disclosure of STUDENT's personal information. By accepting this CONTRACT, STUDENT acknowledges reading and agreeing to the Privacy Policy, available at the bottom of our website.

NOTICES

Asian Driving School may provide notices to STUDENT by email, phone (call or SMS), regular mail, or by posting notices on the website. Notices are deemed received when sent to the email address or phone number provided by STUDENT at registration. Standard message and data rates may apply for SMS notifications.

GOVERNING LAW AND VENUE

This CONTRACT is governed by and construed under the laws of the State of Texas, without regard to its conflict-of-law provisions. Any dispute not subject to arbitration shall be resolved in the appropriate state or federal court in Texas.

CLASS ACTION WAIVER

By enrolling, STUDENT agrees that any dispute with Asian Driving School must be handled individually — not as part of a group or class action lawsuit.

This means STUDENT cannot join with other students to file a combined or class-action claim against Asian Driving School, and Asian Driving School cannot do the same against STUDENT. Every dispute must be resolved one-on-one.

If a court finds this waiver unenforceable, that portion will be removed, but all other terms of this CONTRACT will remain fully in effect.

WAIVER OF RIGHT TO JURY TRIAL

By agreeing to these terms, STUDENT gives up the right to have a jury decide any dispute related to this CONTRACT or the use of our platform.

This means if a disagreement ever goes to court, it will be decided by a judge — not a jury. This applies to any type of claim, whether it involves a contract dispute, personal injury, or any other legal matter.

STUDENT acknowledges that this waiver is made knowingly and voluntarily as part of the agreement to use Asian Driving School's services.

MANDATORY BINDING ARBITRATION

Any dispute, claim, or controversy arising out of or relating to this CONTRACT or STUDENT's use of the platform that is not resolved informally shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Austin, Texas. The arbitrator's award shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

STUDENT agrees that any arbitration shall be conducted on an individual basis only and not as a class, consolidated, or representative proceeding. If this arbitration provision is found unenforceable, the remaining terms of this CONTRACT shall continue in full force and effect.

ATTORNEYS' FEES

If Asian Driving School prevails in any action to enforce this CONTRACT, Asian Driving School shall be entitled to recover reasonable attorneys' fees and costs from STUDENT.

GENERAL PROVISIONS

This CONTRACT constitutes the entire agreement between STUDENT and Asian Driving School regarding use of the platform and supersedes all prior agreements. If any provision of this CONTRACT is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall remain in full force.

Asian Driving School's failure to enforce any provision of this CONTRACT shall not constitute a waiver of that right. STUDENT must provide written notice of any claim within one (1) year of becoming aware of the facts giving rise to such claim; any claim not filed within two (2) years is forever barred.
